Terms of Service

1. Acceptance of Terms

By accessing or using any Van Moose API services (“Services”), you agree to be bound by these Terms of Service. If you do not agree, you may not use the Services.

2. Services Description

Van Moose provides developer utility APIs at vanmoose.cc. The Services are provided on an “as is” and “as available” basis. We may update, modify, suspend, or discontinue any part of the Services at any time.

Some APIs are also available on third-party platforms. Your use of those platforms is subject to their separate terms of service.

3. Payments & No Refunds

All paid plans are billed in advance. All sales are final.

By subscribing to a paid plan, you acknowledge and agree that:

• Payments are non-refundable
• No partial refunds are issued for unused API calls
• No refunds are issued for cancellations during a billing period
• No refunds are issued for any reason whatsoever

4. Limitation of Liability

To the maximum extent permitted by applicable law, Van Moose BV and its affiliates, officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits, revenue, or data
• Business interruption
• Cost of substitute services
• Errors, bugs, or inaccuracies in the Services
• Unauthorized access to or alteration of data
• Third-party conduct or content

In no event shall our total liability exceed the amount paid by you in the twelve (12) months preceding the claim, or one hundred euros (€100), whichever is lower.

5. Disclaimer of Warranties

The Services are provided without warranties of any kind, whether express or implied, including but not limited to:

• Merchantability
• Fitness for a particular purpose
• Non-infringement
• Accuracy or completeness of data
• Uninterrupted or error-free operation

We do not warrant that the Services will meet your requirements or that defects will be corrected.

6. Acceptable Use

You agree not to:

• Use the Services for unlawful purposes
• Circumvent rate limits or usage restrictions
• Resell or redistribute the Services without authorization
• Interfere with or disrupt the Services
• Transmit malware or malicious code
• Violate applicable laws or regulations

7. Rate Limits & Enforcement

API usage is subject to rate limits based on your subscription tier. Exceeding limits or violating these terms may result in suspension or termination of access, without refund.

8. Availability

We aim to maintain reliable service availability but do not guarantee any specific uptime, continuity, or availability level. Scheduled maintenance or outages may occur without notice.

9. Termination

We may suspend or terminate your access to the Services at any time for violation of these terms or for operational reasons. You may stop using the Services at any time, but payments already made are not refundable.

10. Indemnification

You agree to indemnify and hold harmless Van Moose BV and its affiliates from any claims, damages, losses, or expenses arising from your use of the Services or violation of these terms.

11. Privacy

Use of the Services is subject to our Privacy Policy. We process personal data in accordance with applicable EU data protection laws (GDPR).

12. Governing Law

These terms are governed by the laws of the Netherlands. Any disputes shall be submitted exclusively to the courts of Amsterdam, Netherlands.

13. Changes to Terms

We may update these terms from time to time. Continued use of the Services after changes take effect constitutes acceptance of the revised terms.
